In a recent ruling, Judge Roy K. Altman of the Southern District Court in Florida denied a request from several civil organizations seeking to temporarily block SB 1718, a law related to immigrants. The primary reason for the decision was deficiencies in the process of notifying the parties involved.
Judge Altman noted that although the plaintiff organizations, including the Southern Poverty Law Center, ACLU of Florida, Americans for Immigrant Justice, and the American Immigration Council, argued that they had sent relevant copies of the motion to the interested parties, the defendants had not yet been formally served.
The judge therefore emphasized that a defendant has no obligation to respond to a request of which they have not been notified. Accordingly, he described the motion as “premature.”
However, there is a positive development for the organizations involved: they may refile their motion once the defendants have been properly served, which is expected to occur shortly.
The lawsuit in question was filed on behalf of the Florida Farmworkers Association and several affected individuals, including both U.S. citizens and undocumented immigrants who regularly travel within the state.
Additionally, Judge Altman denied the organizations’ request to proceed anonymously in the lawsuit. The reason was similar: the defendants, including Governor Ron DeSantis and other relevant state officials, had not been properly served.
The organizations raised concerns about Section 10 of the law, arguing that it intrudes on federal jurisdiction over immigration matters and contains ambiguities that could be considered unconstitutional.
According to the plaintiffs, SB 1718 conflicts with federal laws and potentially with the Constitution itself, raising serious concerns about its enforceability and fairness.
